Tenant alleges Largo apartment owners' negligence caused fall on trash pile

CLEARWATER — A tenant is suing a Largo apartment owner, alleging negligence caused a fall that injured the plaintiff.

Theresa Fleary filed a complaint Jan. 14 in Pinellas County Circuit Court against Portofino at Largo Condominium Association Inc., alleging failure to correct dangerous conditions of which it knew or should have known of through reasonable care.

According to the complaint, on Nov. 10, 2017, Fleary, a resident of the defendant's apartment complex on Walsingham Road in Largo, she tripped and fell over a pile of furniture and trash that had been left in the parking lot. 

As a result, Fleary says she sustained bodily injuries, resulting in pain and suffering, disability and the expense of hospitalization. 

The plaintiff alleges Portofino at Largo Condominium Association failed to warn Fleary of dangerous conditions in the residents' parking lot and failed to adequately train its employees in maintenance and cleaning techniques regarding the parking lot.

Fleary seeks trial by jury, damages of more than $15,000 and all just and proper relief. She is represented by attorney Bruce M. Kleinberg of Tampa.
