CLEARWATER — A motorist is suing an insurance company, citing alleged breach of contract.
Katherine Rosenthal filed a complaint on Jan. 7 in the 6th Judicial Circuit of Florida-Pinellas County against State Farm Mutual Automobile Insurance Company alleging that it breached its obligation to compensate her pursuant to uninsured/underinsured motorist coverage.
According to the complaint, on Nov. 10, 2015, Rosenthal was operating her vehicle on the public roads of Florida when it was struck by an unknown motorist.
Rosenthal claims she notified the defendant of the collision and filed for uninsured and underinsured motorist coverage. She alleges she is entitled to coverage of all losses sustained.
The plaintiff holds State Farm Mutual Automobile Insurance Company responsible because it allegedly failed to provide uninsured and underinsured motorist coverage that was valid and in full force and effect at the time of the subject collision.
The plaintiff requests a trial by jury and seeks judgement for damages, together with costs, pre- and post-judgment interest and such other relief to which she is entitled. She is represented by Paul Puzzanghera of Puzzanghera Law Offices in Clearwater.
