Couple sues driver and insurer, claiming negligence and breach of contract

CLEARWATER — A husband and wife are suing Arlene W. Kaslander and State Farm Mutual Automobile Insurance Company, driver and insurer, citing alleged breach of contract and negligence.

Antonia M. Favacho and Brent G. Woodell filed a complaint on Jan. 7 in the 6th Judicial Circuit of Florida-Pinellas County against the defendants alleging that  State Farm failed to provide uninsured/underinsured motorist coverage to them.

According to the complaint, the plaintiffs allege that on Jan. 15, 2015, Favacho was operating the automobile owned by her husband, Woodell, when she was involved in an accident with Kaslander's vehicle. She suffered bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish and loss of earnings. Woodell suffered the loss of the society, companionship, services and consortium of his wife. The plaintiffs hold Kaslander and State Farm Mutual Automobile Insurance Company responsible because Kaslander allegedly negligently and carelessly operated her vehicle in a manner so as to cause it to collide with Favacho's vehicle.

The plaintiffs request a trial by jury and seek damages in excess of $15,000 for each of them, plus costs and all issues so triable. They are represented by Debra J. Gell of Ciarciaglino, Gell & Fiorentino, PA in St. Petersburg.
