Property owners claim insurance company breached policy

ORLANDO — Property owners are suing Southern Fidelity Property & Casualty Inc., a licensed insurer, citing alleged breach of policy.

Amaury Cisnero Morales and Yamila Perea Pupo filed a complaint on Jan. 2 in the 9th Judicial Circuit Court of Florida-Orange County against Southern Fidelity Property & Casualty Inc. alleging that it failed to acknowledge coverage for their loss.

According to the complaint, the plaintiffs allege that on Sept. 30, 2018, their property at 4822 Edmee Circle in Orlando sustained a covered loss as a result of water damage due to an AC leak. At the time of the occurrence, the policy issued by the defendant was in full force and effect. 

The plaintiffs hold Southern Fidelity Property & Casualty Inc. responsible because it allegedly failed to make any payment of insurance proceeds to the plaintiffs.

The plaintiffs request a trial by jury and seek damages exceeding $15,000, with interest, costs and attorney's fees. They are represented by Alexandra Ramon of Ramon, Rodriguez, Blanco-Herrera, LLP in Miami.
