Pinellas County residents allege Vermont motorist caused crash

CLEARWATER — Two Pinellas County residents are suing a Vermont motorist, alleging her negligence caused a crash.

Tuan Ha and Vy Nguyen filed a complaint Jan. 3 in Pinellas County Circuit Court against Catherine Diduk of Windham County, Vermont, alleging she caused injuries to the plaintiffs from negligence in operating a rental car.

According to the complaint, on Oct. 9, 2017, Ha and Nguyen were traveling near state Road 694 and 58th Street North in Pinellas Park. The suit says Diduk carelessly operated a vehicle rented from Budget Car Rental so as to collide with the vehicle containing the plaintiffs. 

As a result of the accident, Ha and Nguyen say they sustained bodily injuries, resulting in pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, hospitalization and other medical expenses, loss of earnings, loss of the ability to earn money and aggravation of an existing condition. 

The plaintiffs allege Diduk failed to adequately maintain and operate a motor vehicle so as not to cause harm, and failed to pay attention to traffic and keep a proper lookout for other vehicles.

Ha and Nguyen seek trial by jury and damages in excess of $15,000. They are represented by attorney A. Crosby Crane of Morgan & Morgan Tampa PA in Tampa.
