Property owners sue insurance company, allege breach of contract

CLEARWATER — Property owners are suing Avatar Property & Casualty Insurance Company, a licensed insurer, citing alleged breach of insurance policy.

Terri and Barry Dobson filed a complaint on Dec. 21 in the 6th Judicial Circuit of Florida-Pinellas County against Avatar Property & Casualty Insurance Company alleging that it refused to pay for all of their losses.

According to the complaint, the Dobsons allege that their insured property at 808 Palm Drive in Largo sustained direct physical damage during the policy period. They notified Avatar of the damages, and it assigned a claim with a date of loss of Sept. 10, 2017. They hold Avatar Property & Casualty Insurance Company responsible because it allegedly refused to pay for all of their losses.

The plaintiffs request a trial by jury and seek damages that exceeds $15,000, exclusive of attorney’s fees, costs and interest and all issues so triable. They are represented by James Goodnow of Morgan & Morgan, PA in Tampa.
