Customer alleges TJ Maxx's negligence led to injuries in St. Petersburg store

CLEARWATER — A Pinellas County customer is suing TJ Maxx, alleging the department store chain's negligence and premises liability led to injuries for the plaintiff.

Nicole Mozell filed a complaint Dec. 21 in Pinellas County Circuit Court against The TJX Companies Inc., doing business as TJ Maxx, alleging failure to prevent unreasonable hazards.

According to the complaint, on Jan. 16, 2017, Mozell was in the TJ Maxx store in St. Petersburg, shopping with her son. The suit says an assembled balance bicycle rolled off the upper top shelf, fell and struck Mozell on the right side of her body. She says she sustained bodily injuries, resulting in pain and suffering, disability, disfigurement and expenses for hospitalization, medical and nursing care and treatment. 

The plaintiff alleges TJ Maxx failed to property train or supervise employees regarding the safety matters, including securing items on shelves.

Mozell seeks trial by jury, damages that exceed $15,000, together with court costs. She is represented by attorney John R. Mathias of Law Offices of John R. Mathias PA in St. Petersburg.
