Pharmaceutical company seeks to stop confidential records from becoming public

CLEARWATER — A pharmaceutical company is suing St. Petersburg, alleging breach of duty.

Envision Pharmaceutical Services LLC filed a complaint Dec. 19 in Pinellas County Circuit Court against the city of St. Petersburg, alleging violation of the Florida Public Records Act and Trade Secret Laws.

According to the complaint, on Nov. 27, St. Petersburg mailed a letter to Envision, which indicated that the defendant had received a public records request for a copy of a Envision proposal submitted in response to the request proposal. The suit says the letter was not received by Envision until Dec. 6, and alleges the records contain confidential commercial and financial information and trade secrets provided by the plaintiff. 

The plaintiff says if its confidential information were disclosed, Envision would be irreparably harmed and its ability to compete effectively would be compromised and diminished.

Envision Pharmaceutical seeks trial by jury, an order not to disclose confidential information, attorney fees and court costs, plus all further necessary relief. It is represented by attorneys Joseph M. Goldstein and Meredith A. Freeman of Shutts & Bowen LLP in Tampa.
