St. Petersburg couple alleges insurer failed to cover dwelling damage

CLEARWATER — A St. Petersburg couple is suing an insurance company, alleging breach of contract.

Enton Leka and Irena Leka filed a complaint Dec. 19 in Pinellas County Circuit Court against Avatar Property and Casualty Insurance Company, alleging the defendant wrongfully denied the plaintiffs' request for insurance coverage.

According to the complaint, on June 15, during the plaintiffs' insurance policy period, the Leka property at 753 85th Ave. N., St. Petersburg, suffered a coverage loss due to water damages. 

The Lekas say they notified Avatar of the damages, received an assigned claim number and complied with all conditions precedent to entitle them to recover under the policy. However, the suit says, the defendant waived compliance with the conditions by failing to provide coverage for the covered loss. 

The plaintiffs allege Avatar Property and Casualty Insurance has failed to pay for all of the plaintiffs' losses.

The Lekas seek trial by jury, consequential damages of more than $15,000, plus attorney fees and court costs. They are represented by attorney Morgan Vasigh of Morgan & Morgan PA in Tampa.
