CLEARWATER — A woman is suing Patricia Baldwin and Victoria Fire & Casualty Company, driver and insurer, citing alleged breach of contract and negligence.
Pavielle Hayes filed a complaint on Dec. 18 in the 6th Judicial Circuit of Florida - Pinellas County against the defendants alleging that Baldwin failed to avoid to collision with plaintiff's vehicle and Victoria Fire & Casualty failed to pay uninsured motorist coverage.
According to the complaint, Hayes alleges that on Sept. 16, 2016, she was involved in a vehicle crash on US 19 in Pinellas County. She sustained bodily injuries resulting in pain, mental anguish, medical expenses and loss of ability to earn money. She seeks to recover damages for uninsured motorist coverage under the the policy issued by Victoria Fire & Casualty. She holds Baldwin and Victoria Fire & Casualty Company responsible because Baldwin drove the vehicle that collided with hers and Victoria failed to pay the full amount to which Hayes is legally entitled.
The plaintiff requests a trial by jury and seeks damages that exceed $15,000. She is represented by Martin Macyszyn of Lucas | Magazine PLLC in New Port Richey.
