Motorist blames Bob Evans Restaurants for injuries

CLEARWATER — A motorist is suing Bob Evans Restaurants, alleging negligence led to injuries for the plaintiff.

Gloria M. Samper filed a complaint Dec. 17 in Pinellas County Circuit Court against Bob Evans Restaurants LLC, Bob Evans Farms LLC, National Retail Properties LP, et al, alleging they negligently maintained a strip of adjoining properties in Clearwater.

According to the complaint, on April 27, 2017, Samper was injured in a motor vehicle accident on U.S. Highway 19 North in Clearwater when she was run into by a bicyclist. The suit says Samper sustained serious injuries in and about her body extremities, resulting in pain and suffering, disability, disfigurement, lost wages and medical expenses. 

The plaintiff alleges the defendants failed to maintain the grounds of their properties in a reasonably safe condition regarding sight lines for motorists and failed to give adequate warning of the latent defects or unrevealed dangers.

Samper seeks trial by jury, damages of more than $15,000, interest, court costs and attorney fees. She is represented by attorney Eduardo R. Latour of Latour & Associates PA in Tarpon Springs.
