Orlando homeowner alleges insurer failed to pay for slab leak damage

ORLANDO — An Orlando homeowner is suing an insurer, alleging breach of an insurance contract.

Ida Dickenson filed a complaint Dec. 11 in Orange County Circuit Court against Homeowners Choice Property & Casualty Insurance Company Inc. alleging failure to protect the insured's Orlando home from covered losses.

According to the complaint, on Sept. 7, when her property at 408 Talquin Court, Orlando, was still under the Homeowners Choice homeowners insurance policy, it sustained a covered loss from water damage from a slab leak. However, the suit says, despite Dickenson's efforts to comply with all post-loss obligations, the defendant has failed to fully pay for all of the plaintiff’s losses as required by the insurance policy. 

The plaintiff alleges Homeowners Choice Property & Casualty Insurance has failed or refused to fully perform under the policy, failed to fully pay for all of Dickenson's losses and obligated her to pay for attorney services in bringing legal action.

Dickenson seeks trial by jury, damages of more than $15,000, plus interest on any overdue payments, attorney fees and court costs. She is represented by attorney James J. Dye of Morgan & Morgan PA in Orlando.
