Passenger injured in crash alleges Allstate owes insurance coverage

ORLANDO — A Kissimmee woman is suing Allstate, alleging breach of contract after she was injured in a vehicle crash.

Michelle E. Rusz filed a complaint Dec. 11 in Orange County Circuit Court against Allstate Fire and Casualty Insurance Company, alleging the defendant refused to honor its contractual obligations to provide coverage.

According to the complaint, on June 27, 2017, Michelle E. Rusz was a passenger in a 2013 Dodge Dart when she sustained injuries after a vehicle collision at the intersection of Sand Lake Road and Turkey Lake Road in Orlando. 

Rusz says Allstate had issued her an automobile insurance policy that provided uninsured/underinsured motorist coverage benefits that were in full force and effect at the time of the crash. However, the suit says, after Rusz notified Allstate of the loss, the defendant has refused to provide coverage under the policy. 

The plaintiff alleges Allstate Fire and Casualty Insurance has denied her uninsured motorist claim without conducting a reasonable investigation based on the available information, even disregarding Rusz's repeated offers to assist in its investigation.

Rusz seeks trial by jury, judgment of at least $15,000 for the uninsured/underinsured motorist benefits under the policy and all other just and proper relief. She is represented by attorney Harold S. Velez of Morgan & Morgan PA in Orlando.
