Pinellas County customer alleges restaurant operator's negligence caused fall

CLEARWATER — A Pinellas County woman is suing a Gulfport restaurant, alleging negligence and premises liability.

Mary Jane Stockett filed a complaint Dec. 10 in Pinellas County Circuit Court against Manatees on the Bay, alleging the defendant failed to adequately maintain the entrance and exit of its restaurant for the safety of its invitees.

According to the complaint, on Feb. 2, Stockett was was a patron at the defendant's restaurant in Gulfport when she fell on the uneven and broken sidewalk at the entrance/exit of the restaurant. She says she sustained injuries and damages, resulting in physical and mental pain, loss of wage-earning capacity and lost the ability to lead and enjoy a normal life. 

The plaintiff alleges Manatees on the Bay failed to inspect the sidewalk that was broken and uneven, failed to fixed the dangerous condition and failed to give adequate warning.

Stockett seeks trial by jury, damages that exceed $15,000, interest, court costs and attorney fees. She is represented by attorney Joseph A. Kopacz of Morgan & Morgan Tampa PA in Tampa.
