Motorist sues Toyota Tundra owner, alleging negligence

CLEARWATER — A motorist is suing Owen Brenner, a Toyota Tundra owner, citing alleged negligence.

Colleen Kelly filed a complaint on Dec. 10 in the Pinellas Circuit Court against Owen Brenner alleging that he breached his duty owed to operate a motor vehicle safely.

According to the complaint, the plaintiff alleges that on Feb. 2, 2018, she was involved in an accident in Pinellas County. She was injured in and about her body and extremities and was caused to suffer pain, medical expenses and loss of enjoyment of life. The plaintiff holds Owen Brenner responsible because he  allegedly failed to yield right of way and negligently entered the intersection on a red light.

The plaintiff requests a trial by jury and seeks damages that exceed $15,000, costs and such further relief as the court may deem proper. She is represented by Joseph F. Diaco Jr. of Diaco Law in Tampa.
