Orlando real estate buyers accuse sellers of breach of duty

ORLANDO — Two real estate buyers are suing a broker and an agent, alleged breach of duty and negligence.

Jorge Perez and Luis Delgado filed a complaint Dec. 5 in Orange County Circuit Court against Walker and Tudhope PA and Luxury Realty Inc., alleging failure to exercise reasonable care in obtaining or communicating important information.

According to the complaint, on May 23, Perez and Delgado closed the sale of a property at 3190 Dante Drive, Unit 207, Orlando. As a result of defendants' carelessness, the suit says, the plaintiffs wired the sum of $136,890.42 to a "Fraudster's" account at SunTrust Bank in conformance with the altered wiring instructions. 

The plaintiffs allege the defendants failed to employ customarily accepted best practices to protect the confidential and sensitive information communicated.

Perez and Delgado seek damages that exceed $15,000, with court costs, interest and attorney fees. They are represented by attorneys M. Bradley Luczak and Mark Bradley Luczak II of White & Luczak PA in Winter Park, and by Philip Tatich of Winter Park.
