Driver claims other motorist was negligent

ORLANDO — A vehicle driver is suing another vehicle owner and driver, citing alleged negligence.

Ilia M Roy Falou filed a complaint on Dec. 6 in the 9th Judicial Circuit Court of Florida-Orange County against Godwin Prospere and Yan Kirk Prospere alleging that the defendants breached their duty to exercise reasonable care in the operation and/or use of the vehicle for the benefit of other individuals on public roadways.

According to the complaint, on Dec. 5, 2017, defendant Yan Kirk Prospere was the operator of the vehicle, which belonged to defendant Godwin Prospere, that allegedly failed to maintain a safe distance;  failed to operate the automobile in a safe, reasonable, and prudent manner; and ultimately was involved in the collision with a vehicle properly operated by the plaintiff, Ilia M Roy Falu. 

As a result, plaintiff claims, she sustained physical injuries, pain and suffering, and medical expenses. 

The plaintiff holds defendants responsible because defendant Yan Kirk Prospere allegedly failed to pay proper attention to the roadway and the traffic, failed to maintain a proper lookout and failed to obey the traffic control device to avoid a collision.

The plaintiff requests a trial by jury and seeks judgment for damages in a sum in excess of $15,000, plus costs and interest and such other relief to which the plaintiff may be justly entitled. She is represented by Kyle R. Alessi of Nicholas Law Group, PLLC in Tampa.
