CLEARWATER — A customer is suing Tarpon Springs restaurant operators, alleging negligence led to the plaintiff being assaulted.
Henry Bradford Case filed a complaint Dec. 4 in Pinellas County Circuit Court against Eagle's Nest Lounge and Mirabella Limited Partnership, alleging failure to exercise reasonable care to protect their invitees.
According to the complaint, on July 24, 2016, Case was a patron at Eagle’s Nest Lounge in Tarpon Spring when other patrons caused a disturbance. There was violent behavior, the suit says, and one of the patrons struck Case from behind, causing him to fall and lose consciousness.
Case says he sustained bodily injuries, resulting in disability, pain and suffering, disfigurement, medical expenses and loss of earnings. The plaintiff alleges the defendants failed to provide adequate security and failed to provide adequate warning of the known dangerous propensities of particular patrons/customers.
Case seeks trial by jury, damages in excess of $15,000, exclusive of interests, court costs and attorney fees. He is represented by attorney Chelsie M. Lamie of Personal Injury Law Office of Chelsie M. Lamie, PA in Safety Harbor.
