Apopka homeowner alleges insurance company failed to cover property damage

ORLANDO — An Apokpa property owner is suing a liability insurer, alleging breach of contract regarding property damage.

Efrain Duany filed a complaint Nov. 29 in Orange County Circuit Court against American Security Insurance Company, alleging failure to pay all benefits due under the terms of the policy.

According to the complaint, on Nov. 30, 2013, Duany found progressive physical damage to the walls and floors of his insured property at 1306 Prairie Lane in Apopka. Duany says he has made an application for insurance benefits under the American Security policy. However, the plaintiff alleges, American Security Insurance has failed and refuses to pay benefits for the covered loss.

Duany seeks trial by jury, damages in excess $15,000, exclusive of interest, attorney fees, court costs and all other proper relief. He is represented by attorneys Robert L. Nipps of Tampa and by Ryan S. Burke and Wesley Dicus of Dicus & Burke PLLC in St. Petersburg.
