Property owner sues insurance company, alleges breach of contract

ORLANDO — A property owner is suing Southern Fidelity Property & Casualty Inc., a licensed insurer, citing alleged breach of insurance policy.

Jorge H. Montero filed a complaint on Nov. 29 in the 9th Judicial Circuit Court of Florida Orange County against Southern Fidelity Property & Casualty Inc. alleging that the licensed insurer failed to acknowledge coverage for a loss.

According to the complaint, on Sept. 27, 2017, Montero's property at 302 Chicago Woods Circle in Orlando sustained a covered loss as a result of a water leak. Montero satisfied all post-loss obligations in accordance with the policy and made a claim for such loss. The plaintiff holds Southern Fidelity Property & Casualty Inc. responsible because it allegedly failed to make any payment of insurance proceeds for his loss.

The plaintiff requests a trial by jury and seeks damages that exceed $15,000, exclusive of interest, costs and attorney’s fees. He is represented by Alexandra Ramon of Ramon, Rodriguez, Blanco-Herrera, LLP in Miami.
