Family member alleges Disney negligence proved fatal

ORLANDO — A family member is suing Walt Disney, alleging negligence led to the death of a relative.

Niurka Figueroa, as administrator for the estate of Natacha Figueroa, filed a complaint Nov. 29 in Orange County Circuit Court against Walt Disney Parks & Resorts US Inc., alleging the defendant failed to follow applicable safety guidelines and regulations.

According to the complaint, on Dec. 3, 2014, Natacha Figueroa was a wheelchair passenger on a Disney bus traveling from the Magic Kingdom to All-Star Sports Resort. The suit says during the ride Figureroa's wheelchair tipped over because a Disney employee had failed to secure it properly. 

The lawsuit alleges Figueroa sustained bodily injuries, pain and suffering, disability, impairment, disfigurement, mental anguish, inconvenience, loss of enjoyment of life, aggravation of an existing disease, and incurred medical expenses. The suit says Figueroa's injuries eventually led to her death Oct. 22, 2015.  

The plaintiff alleges Walt Disney Parks & Resorts failed to properly train its employees and/or agents on the proper manner in securing a wheelchair, failed to properly secure and inspect the wheelchair, and failed to warn the decedent of the latent danger presented by the unsecured wheelchair.

Niurka Figueroa seeks trial by jury, compensatory damages in excess of $15,000, court costs and interest. the plaintiff is represented by attorneys Russell A. Dohan of Dohan Law Group PA in Coral Gables, and by Nadine Figueroa of Law Offices of Jimmy De La Espriella PA in Coral Gables.
