Orlando homeowners allege insurer failed to pay for water damage

ORLANDO — Orlando homeowners are suing an insurer, alleging breach of an insurance contract.

Angel Rohena and Yonidy Pena filed a complaint Nov. 29 in Orange County Circuit Court against American Strategic Insurance Corp., alleging failure to pay for water damage. 

According to the complaint, on July 18, the Rohena and Pena property at 1077 Vista Palma Way, Orlando, sustained a covered loss from a sudden and accidental discharge of water in the kitchen due to plumbing problems. 

Although the plaintiffs say they have paid all premiums due and owing and satisfied all post-loss obligations to the best of their ability, American Strategic has denied coverage for the loss on the false basis that it was not covered by the policy. 

The plaintiffs allege American Strategic Insurance has failed to acknowledge that payment would be forthcoming, and/or failed to make any payment of insurance proceeds.

Rohena and Pna seek trial by jury, damages of more than $15,000, plus court costs and attorney fees, and all other just relief. They are represented by attorneys Anthony M. Lopez and Daniela Barreto of Marin, Eljaiek, Lopez & Martinez PL in Coconut Grove.
