St. Petersburg property owner alleges insurance company failed to pay for hurricane damage

CLEARWATER — A St. Petersburg property owner is suing a licensed insurer, alleging breach of an insurance policy.

Thuy Zamites filed a complaint Nov. 26 in Pinellas County Circuit Cour against Heritage Property & Casualty Insurance Company, alleging failure to account for all the damage to the plaintiff's property after a hurricane.

According to the complaint, on Sept. 10, 2017, Zamites' property at 3244 Jackson St., N., St. Petersburg, sustained a covered loss due to Hurricane Irma. The suit says Zamites applied for insurance benefits under the policy issued by Heritage Property. 

The plaintiff alleges Heritage Property & Casualty Insurance has failed and refuses to pay all the benefits to which she is entitled.

Zamites seeks trial by jury, damages of more than $15,000, plus interest, court costs, attorney fees and all other just and equitable relief. She is represented by attorneys A. Lee Smith and Mark A. Dombrosky of Smith, Kling & Thompson PA in Tampa.
