Property owners sue insurance company, citing breach of contract

ORLANDO — Property owners are suing Florida Specialty Insurance Company, a licensed insurer, citing alleged breach of insurance policy.

David Gilmore and Dawn Gilmore filed a complaint Nov. 19 in the 9th Judicial Circuit Court against Florida Specialty Insurance Company alleging that the licensed insurer breached its obligation to pay insurance benefits for plaintiffs' covered loss.

According to the complaint, the plaintiffs allege that David Gilmore and Dawn Gilmore suffered direct physical damage to their insured property at 12742 Windermere Isle Place in Windermere. At the time of the occurrence, the insurance policy issued by defendant was in full force and effect. The plaintiffs holds Florida Specialty Insurance Company responsible because the defendant allegedly failed and refused to properly investigate the loss, and has failed and refused to tender all insurance proceeds due under the policy.

The plaintiffs request a trial by jury and seek damages of more than $15,000, exclusive of interest, costs and attorney's fees and such other appropriate relief. They are represented by James S. Constable of Constable Law PA in Safety Harbor.
