Homeowners association alleges contractor's negligence caused property damage

ORLANDO — An Orlando homeowners association is suing a contractor, alleging negligence caused extensive property damage.

Village Walk at Lake Nona Homeowners Association Inc. filed a complaint Nov. 13 in Orange County Circuit Court against KPMG LLP, and JR Davis Construction Company Inc., alleging failure to follow applicable safety guidelines and regulations.

According to the complaint, the defendants' negligent construction of a project resulted in the collapse of Upper Village Walk Circle and adjacent roads owned by the homeowners association, the destruction of a sanitary sewer line and other damages. 

The suit says the defendants were negligent in dewatering and excavating land at the project site for the construction of a retention pond, resulting in the subsidence of soils, the collapse of concrete roadways and the physical removal and destruction of property, which created a hazardous condition. 

The plaintiff alleges the defendants breached their duty by negligently dewatering and/or excavating the land at the project, and interfered with property interests of the association and its members and their use and enjoyment of the property.

Village Walk at Lake Nona Homeowners Association seeks trial by jury, damages of more than $15,000, a temporary and permanent injunction, court costs, pre-judgment interest, and all other just and proper relief.
