CLEARWATER — A Pasco County resident is suing an insurance company, citing alleged breach of contract.
Ralph Scaperotti filed a complaint on Nov. 16 in the 6th Judicial Circuit of Florida-Pinellas County against Progressive Express Insurance Company alleging that the defendant breached its duty under the insurance contract to compensate plaintiff for the bodily insurance coverage after a vehicle accident.
According to the complaint, on Nov. 24, 2015, Ralph Scaperotti suffered a vehicle collision after motorist Ashley Brooke struck the vehicle in which he was a passenger.
Plaintiff claims Ashley Brooke tendered only $30,000 in bodily insurance coverage and therefore seeks defendant to provide uninsured/underinsured motorist coverage as he had a full force and effect policy insurance that defendants allegedly refuses to provide.
The plaintiff holds Progressive Express Insurance Company responsible because the defendant allegedly failed to reach an amicable compromise of the plaintiff's claim despite plaintiff having a full force and effect insurance policy.
The plaintiff requests a trial by jury and seeks judgment for an amount in excess of $15,000, exclusive of costs and interest, and further relief deemed just. He is represented by Eduardo R. Latour of Latour & Associates, PA in Tarpon Springs.
