Homeowners sue insurance company for breach of policy

ORLANDO — Homeowners are suing USAA Casualty Insurance Company, a licensed insurer, citing alleged breach of insurance policy.

Donna Hardwick and Gregory Hardwick filed a complaint on Nov. 13 in the 9th Judicial Circuit Court of Florida-Orange County against USAA Casualty Insurance Company alleging that the licensed insurer denied payment for water damage.

According to the complaint, the plaintiffs allege that on Dec. 28. 2016, Donna Hardwick and Gregory Hardwick's dwelling located at 1341 N. Lake Sybelia Drive in Maitland sustained water damage. Plaintiffs timely notified defendant and provided an estimate for such damage to recover adequate compensation for repairs. The plaintiffs holds USAA Casualty Insurance Company responsible because the defendant allegedly failed and refused to cover the full damage to their residence.

The plaintiffs request a trial by jury and seek damages of more than $15,000, exclusive of interest, costs and attorney's fees. They are represented by Steven M. Johnson of Johnson & Williams PA in Orlando.
