BMW driver sued after high-speed crash that killed two people

ORLANDO — Personal representatives are suing motorist Justin Fonner, alleging that he caused a car accident that killed two people.

Marlin Betancourt and Adelaida Perales-Rodriguez filed a complaint on Nov. 8, in the 9th Judicial Circuit Court for Orange County, against the defendant alleging that he drove his BMW over 120 mph in a 35 mph zone and crashed into another vehicle.

The plaintiffs allege that on December 31, 2017, Geena Pabarue and Keisha Oyola-Perales were traveling in a vehicle near Westchester and Orange Avenue in Orange County, Florida, when the defendant negligently operated a 2015 BMW M6 at a high rate of speed, striking their vehicle.

 Pabarue and Oyola-Perales suffered catastrophic injuries that resulted in their death, and injuries to next-of-kin. Damages include funeral and death expenses, and the loss of their support, services, companionship, comfort, attention and protection. 

The plaintiffs hold Justin Fonner responsible because the defendant allegedly failed to drive his vehicle at a safe speed, failed to look out for other vehicles and failed to maintain a safe distance from other vehicles.

The plaintiffs request a trial by jury and seek judgment against defendant for damages that exceed $15,000.
