CLEARWATER — A Pinellas County woman is suing Winn-Dixie, alleging breach of duty and negligence led to injuries for the plaintiff.
Deborah Fragale filed a complaint Nov. 9 in Pinellas County Circuit Court against Cabrera Cleaning LLC and Winn-Dixie Store Inc., alleging the defendants failed to maintain a business premises in a reasonably safe condition.
According to the complaint, on Nov. 25, 2014, Fragale visited a Winn-Dixie Store premises as a patron on Tampa Road in Pinellas County when she slipped and fell in an unmarked area being cleaned by Cabrera Cleaning.
As a result Fragale says she sustained physical injuries, disability and medical expenses.
The plaintiff alleges the defendants allowed a dangerous, hazardous and unsafe condition to exist on the premises and failed to warn of the dangerous condition by posting signs or blocking off the area.
Fragale seeks trial by jury, damages in excess of $15,000, plus costs and all other just and proper relief. She is represented by attorney Thomas W. Cope of Cope, Zebro & Crawford PL in Clearwater.
