CLEARWATER — A Pinellas County man is suing a local business, alleging breach of contract in failing to pay more than $38,000.
Michael Meyer filed a complaint Nov. 7 in the Pinellas County Circuit Court against Vino Simpatico Inc., alleging breach of a promissory note contract by defaulting on instalment payments.
According to the complaint, on Aug. 30, 2016, Vino Simpatico executed and delivered a promissory note in the amount of $47,000, made payable to Meyer.
Meyer says he is the original payee on the note, the owner and holder of the note and has the right to enforce payment as the defendant defaulted on the instalment due May 1, 2017.
The plaintiff alleges Vino Simpatico has defaulted and failed to pay installments under the note with an unpaid principle balance of $38,242.86, plus costs incurred.
Meyer seeks trial by jury, damages of $38,242,86 for unjust enrichment, plus costs, fees, interest and all other just and proper relief. He is represented by attorneys J. Patrick Walsh, Ryan Schmidt and Jon B. Coats Jr. of Coats Schmidt PA in St. Petersburg.
