Customer alleges Winn-Dixie negligence caused injuries

CLEARWATER — A Madeira Beach woman is suing Winn-Dixie, alleging negligence and premises liability.

Twyla Gordon filed a complaint Nov. 8 in Pinellas Circuit Court against Winn-Dixie Stores Inc,. alleging failure to act with reasonable care and safety so as to avoid injury to its invitees.

According to the complaint, on July 8, 2015, Gordon was inside a Winn-Dixie on 1500 Municipal Drive, madeira Beach when she slipped on a clear liquid substance and fell. Gordon says she sustained bodily injuries, resulting in pain and suffering, disability, disfigurement, mental anguish, loss of capacity to enjoy life and loss of earnings. 

The plaintiff alleges Winn-Dixie Stores negligently allowed a clear liquid substance to exist in an area where patrons walk and failed to warn of the dangerous condition created by the clear liquid substance on the floor.

Gordon seeks trial by jury, damages of more than $15,000, exclusive of interest, costs and attorney fees. She is represented by attorney Luis R. Gracia of Rue & Ziffra in Port Orange.
