Consumer accuses bank of unfair collection practices

CLEARWATER — A Pinellas County woman is suing a bank, alleging unfair and abusive debt collection practices.

Lynn Hayden filed a complaint Nov. 8 in Pinellas Circuit Court against Suntrust Bank, alleging violation of the Florida Consumer Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, on April 26, 2017, Suntrust Bank began communicating with Hayden, attempting to collect an alleged debt. As a result of the continued barrage of debt collection communications, the suit says, Hayden has been annoyed, harassed, frightened, embarrassed and/or humiliated. 

The plaintiff alleges Suntrust Bank has made calls using an automated telephone dialing system and continued to communicate with her even after her request to cease all communications and to direct all communications to her counsel.

Hayden seeks trial by jury, damages between $5,000 and $15,000, exclusive of attorney fees, court costs and all other proper relief. She is represented by attorney Sean E. McEleney of LeavenLaw in St. Petersburg.
