CLEARWATER — Two Redington Beach property owners are suing the town, alleging unauthorized physical invasion of private land.
Pamela Greacen and Arthur L. Buser Jr. filed a complaint Oct. 29 in Pinellas Circuit Court against the town of Redington Beach, alleging the municipal government wrongfully enacted an ordinance that impedes or interferes with the right of the public at large to utilize the dry sand areas of the beach that are owned by private entities.
According to the complaint, Greacen and Buser are the owners of a beachfront property at 16120 Gulf Blvd. in Redington Beach that fronts the Gulf of Mexico. As a result of the defendant's actions, the suit says, the plaintiffs have lost the economic benefits of their property and have been frustrated.
The plaintiffs allege the town of Redington Beach wrongfully maintained a public bench on their property.
Greacen and Buser seek trial by jury, an order declaring the customary use ordinance was invalid and void, monetary damages that exceed $15 ,000, exclusive of interest, attorney fees and all other appropriate relief.
