Former employee accuses Honeywell, claims administrator of violating ERISA

CLEARWATER — A Pinellas County woman is suing Honeywell and a claims administrator, alleging violation of ERISA.

Donna Boye filed a complaint Oct. 30 in Pinellas County Circuit Court against Honeywell International Inc. and Life Insurance Company of North America (LINA), alleging violation of ERISA through non-payment of plan benefits.

According to the complaint, Boye has suffered damages from Honeywell's termination of payment for her benefits under the short-term disability plan. Subsequently, Boye said she appealed denial of the claims on Feb. 21, by sending evidence through claims administrator LINA, proving that she was disabled and that benefits were payable. 

However, the suit says, Honeywell has not responded, causing the plaintiff to be deprived of the aggregate sum of $34,285.18. Additionally, Boye says, she suffered further from LINA's denial of her claim for long-term disability benefits at the rate of $4,603.35 per month, despite having met the definition of total disability based upon restrictions and limitations stemming from chronic depression, lack of concentration and an inability to handle stress. 

The plaintiff alleges Honeywell International and Life Insurance Company of North America have failed and refused to pay benefits for Boye's long-term and short-term disability benefits, and obligated the plaintiff to retain and pay for legal counsel to represent her.

Boye seeks trial by jury, damages of more than $15,000 for disability benefits, attorney fees and costs of action. She is represented by attorneys William C. Demas and John V. Tucker of Tucker & Ludin PA in St. Petersburg.
