Wholesale distributor alleges roofing contractor owes nearly $46,000

CLEARWATER — A Pinellas County wholesale distributor is suing a roofing contractor, alleging breach of contract.

SRS Distribution Inc., doing business as Suncoast Roofers Supply, filed a complaint Oct. 30 in Pinellas County Circuit Court against Fortress Roofing Inc. and Michael S. Melcher, alleging failure to pay nearly $46,000. 

According to the complaint, Suncoast Roofers Supply has suffered monetary damages as a result of the wrongful conduct of the defendants in not paying for purchased roofing materials and supplies totaling $45,744.09. 

The plaintiff alleges Fortress Roofing and Melcher have failed to pay in accord with the terms of the contract, and received and retained the benefit of goods and materials without paying dues to the expense and detriment of the plaintiff.

Suncoast Roogers Supply seeks trial by jury, damages of $45,744.09, plus interest, attorney fees and court costs. They are represented by attorney Robert E. Burguieres of St. Petersburg.
