Winter Garden customer accuses home builder of breach of contract

ORLANDO — A Winter Garden customer is suing a home builder, alleging breach of contract and breach of warranty.

Christopher Pickell filed a complaint Oct. 19 in Orange County Circuit Court against Lennar Corporation, alleging the property lacked proper air conditioning.

According to the complaint, as a result of the defendant's failures in the construction of his home at 10055 Bedtime Story Drive, Winter Garden, Pickell has suffered damages. The suit said these include the payment of higher energy costs, anxiety, emotional distress and legal threats from the homeowners’ association due to Pickell having to install an air conditioning window unit in his home to maintain a comfortable temperature. 

The plaintiff alleges Lennar failed to provide an air conditioning unit suitable for cooling of the two-story, 2,500- square-foot home, leading to loss of enjoyment of life.

Pickell seeks trial by jury, damages of $5,000, costs to upgrade the current air conditioning unit, reasonable attorney fees and court costs. He is represented by attorney Jason Brian Phillips of Orlando.
