Pinellas County nursing home accused of causing patient to suffer sepsis

CLEARWATER — A Pinellas County woman is suing a nursing home, alleging negligent supervision.

Angela Kersey, as next friend of Nicole Aspinwall, filed a complaint Oct. 29 in Pinellas County Circuit Court against Tarpon Rehabilitation Center LLC, doing business as Tarpon Bayou Center, alleging the defendant failed to provide a resident her nursing home resident's rights as set forth in Florida law.

According to the complaint, while a resident at the defendant's Tarpon Bayou Center, Aspinwall, who is older than 60,  was suffering from the infirmities of aging and required the defendant's health care services. 

However, Kersey alleges Aspinwall suffered the development and deterioration of infection and sepsis as Tarpon Bayou Center failed to develop an adequate care plan and failed to properly monitor and supervise the care and treatment Aspinwall needed. 

The plaintiff alleges Tarpon Bayou Center failed to develop, implement, and update an adequate and appropriate resident care plans to meet Aspinwall's custodial needs and failed to appropriately monitor and recognize significant signs and symptoms of change in her health condition, such as suffering the development and deterioration of infections and sepsis.

Kersey seeks trial by jury, compensatory damages of more than $15,000, pre-judgement interest, and punitive damages. She is represented by attorney William A. Dean of Ford, Dean & Rotundo PA in Aventura.
