Piinellas County wellness company accuses former employee of breach of contract

CLEARWATER — A Pinellas County wellness company is suing a former employee, alleging breach of an employment agreement.

Tampa Fitness Partners, doing business as Orange Theory Fitness, filed a complaint Oct. 29 in Pinellas Circuit Court against Tiffany Walling, alleging the former employee solicited business through social media for a competitor.

According to the complaint, on Oct. 10, 2017, Orange Theory Fitness entered into a nondisclosure and non-competition agreement with Walling. On March 12, 2018, the suit says, Walling's relationship with the plaintiff was terminated due to her theft from Orange Theory Fitness. 

As a result of Walling's conduct, the plaintiff says, its business has been damaged. The plaintiff alleges Walling disclosed confidential trade secrets or proprietary information to Orange Theory's competitor, known as Spenga.

Orange Theory Fitness seeks trial by jury, damages that exceed $15,000, exclusive of costs and interest, and all equitable relief. It is represented by attorneys Nathan M. Wheat and Jennifer M. Clark of Murray, Morin & Herman PA in Tampa.
