CLEARWATER — A St. Petersburg couple is suing an insurer, alleging breach of an insurance contract.
Rosemarie and Felix Strachan filed a complaint Oct. 30 in Pinellas County Circuit Court against Florida Peninsula Insurance Company, alleging the insurer failed to cover damages caused by a hurricane.
According to the complaint, on Sept. 10, 2017, while the insurance policy for the Strachan property at 3820 First Ave. S., St. Petersburg was still in full force and effect, they sustained economic damages, including substantial repair costs for the covered structure, roofing and interior, due to the sudden and unexpected damages of Hurricane Irma. Although the plaintiffs say they made a timely claim for their loss and performed all requirements prior to filing claim, Florida Peninsula has failed or refused to provide full coverage under the insurance policy.
The plaintiffs allege Florida Peninsula Insurance breached the insurance contract by not compensating the Strachans for their covered loss to their property, and failed to pay promptly the full amounts due.
The Strachans seek trial by jury, actual and compensatory damages, pre-judgment interest, costs of action, attorney fees, and all further appropriate relief. They are represented by attorneys Grant W. Krapf and Kyle Staggs of Krapf Legal PA in Dunedin.
