Pinellas County motorist alleges another driver's negligence caused crash

CLEARWATER — A Pinellas County motorist is suing another driver, alleging negligence caused a crash that injured the plaintiff.

Paul Ernst filed a complaint Oct. 30 in Pinellas County Circuit Court against Wassim Tobias, alleging the defendant failed to exercise standard care and skill in the operation of a motor vehicle.

According to the complaint, on April 5, while Ernst was operating a vehicle on Druid Road in Clearwater, Tobias negligently caused his motor vehicle to collide with the plaintiff's car. As a result of the crash, Ernst says he sustained bodily injuries, resulting in pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, costs for medical, nursing care and treatment, loss of earnings and possible aggravation of a previous existing condition. 

The plaintiff alleges Tobias failed to adequately maintain and operate a motor vehicle so as not to cause harm, and failed to pay attention to traffic and keep a proper lookout for other vehicles.

Ernst seeks trial by jury, damages in excess of $15,000, plus interest and court costs. He is represented by attorney Stephen R. Kanzer of Morgan & Morgan Tampa PA.
