Daughter blames nursing home operators for father's injuries

CLEARWATER — A daughter is suing Palm Harbor nursing home operators, alleging negligence caused injuries to her father.

Susan Wincher, as power of attorney for John Huckleberry, filed a complaint Nov. 26 in Pinellas Circuit Court against 2600 Highlands Boulevard North LLC, doing business as Bay Tree Center and Genesis Healthcare Inc., alleging they breached their duty to their residents to provide reasonable care.

According to the complaint, on Dec. 13, 2017, the plaintiff's father John Huckleberry, was a resident at the defendants' Bay Tree Center nursing home facility. The suit says a staff member operating the lift that wraps sheets around Huckleberry's leg caused the sheets to become caught and tangled, causing the patient's leg to snap and fracture. 

The lawsuit states Huckleberry sustained pain and suffering, disability, disfigurement, mental anguish and the expense of hospitalization, medical and nursing care and treatment. The plaintiff alleges the defendants failed to properly and safely transfer Huckleberry, failed to react to a his complaints and failed to timely react to a his injuries.

Wincher seeks a trial by jury, damages of more than $15,000, exclusive of interest, costs and attorney fees. She is represented by attorney David J. Brevda of Senior Justice Law Firm in Boynton Beach.
