Clearwater mall customer alleges negligence's led to fall, injuries

CLEARWATER — A Brevard County woman is suing a Clearwater mall operator, alleging negligence led to injuries for the plaintiff.

Theresa Cuffie filed a complaint Oct. 26 in Pinellas Circuit Court against Westfield LLC, alleging the mall operator failed to exercise reasonable care for the safety its invitees.

According to the complaint, on June 9, 2017, Cuffie was shopping at the defendant's mall in Clearwater when she slipped and fell on a large spilled drink that was splattered on the floor near the Teavana store. The suit says Cuffie was injured in and about her body and extremities, incurred medical expenses, pain and suffering and a loss of wage earning capacity. 

The plaintiff alleges Westfield failed to maintain the floor by allowing a spilled drink to remain on the floor's surface for a for a sufficient length of time and failed to give adequate warning of the danger of slipping on the substance.

Cuffie seeks trial by jury and damages of more than $15,000. She is represented by attorney Joseph A. Kopacz of Morgan & Morgan, Tampa PA in Tampa.
