Former business owner alleges he has yet to receive royalties

ORLANDO — An Orange County man is suing a former business partner, alleging breach of contract and unjust enrichment.

Joseph Warren Stufft filed a complaint Oct. 17 in Orange County Circuit Court against Paul E. Labelle, alleging failure to pay royalty payments.

According to the complaint, in August 2013, Stufft agreed to sell AirBrush Wizards to Labelle for $250,000 payable in installments, plus royalty payments of 7 percent of the gross sales once the original $250,000 was paid. 

After completing payment, Stufft says he has yet to receive royalty payments beginning in September 2016. To date, the suit says, no royalty payments have been received by the plaintiff. 

The plaintiff alleges Labelle, despite demand for royalty payments pursuant to the terms of the contract, has failed and refused to do so.

Stufft seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. He is represented by attorney Mark L. Graham of Richard A. Heller PA in Winter Park.
