CLEARWATER — A Florida company is suing a property lessor, citing alleged breach of contract.
Shawn Kelly Streib, LLC filed a complaint on Oct. 17 in the 6th Judicial Circuit of Florida-Pinellas County against Raho Pass-A-Grille, Inc. alleging that the defendant breached the lease agreement by denying the extend of lease despite assurance that the lease had been extended.
According to the complaint, on June 30, 2017, Shawn Kelly Streib, LLC as tenant of defendant delivered a letter of formal request to renew lease for an additional five years and made payment on or before the first day of the month as required in the contract.
Plaintiff has expended thousands of dollars and dozens of labor hours renovating and repairing the property in reliance on RAHO’S assurance that the lease had been extended. However, on Sept. 28, 2018, it receive a letter from defendant alleging "Notice of Termination of Lease" indicating the defendant does not recognize the lease extension and will move forward with a removal of tenant action.
The plaintiff holds Raho Pass-A-Grille, Inc. responsible because the defendant allegedly failed to honor the lease agreement by denying plaintiff's request of lease extension despite its promise of assurance and requesting an advance payment.
The plaintiff requests a trial by jury and seeks judgment declaring that plaintiff has a valid lease, award of attorney's fees, costs, and other relief the Court deems just and proper. It is represented by John R. Cappa II of John R. Cappa, PA in St. Petersburg.
