Winter Garden property owners allege insurance carrier failed to pay for hurricane damage

CLEARWATER — Two Winter Garden property owners are suing a licensed insurer, alleging breach of an insurance contract.

Ramcharan Ganesh and Leela Ganesh filed a complaint Oct. 17 in Pinellas Circuit Court against Modern USA Insurance Company, alleging failure to fully perform under the policy.

According to the complaint, on Sept. 11, 2017, the Ganesh property at 1815 Delafield Drive, Emarld Ridge, Winter Garden, sustained damage as a result of Hurricane Irma. At the time of the storm, the suit says, the Modern USA insurance policy was in full force and effect.

The Ganeshes say they notified the defendant of the damages but Modern USA Insurance has failed to fully pay for all the plaintiffs’ losses as required by the insurance policy.

The Ganeshes seek trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. They are represented by attorney Roger A. Hatfield of Morgan & Morgan PA in Orlando.
