CLEARWATER — A Pinellas County motorist is suing another driver and Geico, alleging negligence and breach of an insurance contract.
Lynn Kindness filed a complaint Oct. 17 in Pinellas Circuit Court against David Winstin and Geico General Insurance Company, alleging Winstin failed to operate his motor vehicle in a careful and prudent manner.
According to the complaint, on April 12, Kindness was involved in a vehicle collision on Sunset Road in Pinellas County when Winstin drove his 2008 Mitsubishi into the plaintiff's car. She says she sustained injuries, resulting in pain and suffering, mental anguish, disfigurement, disability, loss of earnings and medical expenses.
At the time of the accident, the suit says, Kindness' Geico insurance policy was in full force and effect for which she seeks to recover under-insured motorist benefits. The plaintiff alleges Winstin failed to carry adequate bodily insurance to compensate for Kindness' losses.
Kindness seeks trial by jury and damages of more than $15,000. She is represented by attorney Christopher Dyer of The Law Office of Lucas I Magazine in New Port Richey.
