ORLANDO — A consumer is suing John Doe, Airport Chrysler Dodge Jeep LLC and Citizens One Auto Finance, individual, dealership and bank, citing alleged fraud.
Richard Harary filed a complaint on Oct. 11 in the 9th Judicial Circuit Court of Florida-Orange County against the defendants alleging that defendant bank failed to adequately train its employees be on guard against fraudulent impersonations.
According to the complaint, the plaintiff alleges that on June 9, 2018, defendant Doe obtained a loan using plaintiff's identity and obtained a loan and drove away with a vehicle costing over $55,000. He has been damaged for being liable for the said amount. The plaintiff holds John Doe, Airport Chrysler Dodge Jeep LLC and Citizens One Auto Finance responsible because defendants bank and dealership failed to implement safeguards to prevent identity theft by negligently allowing Doe to obtain an auto loan of more than $55,000 in his name.
The plaintiff requests a trial by jury and seeks damages of more than $15,000, exclusive of interest, costs and attorney's fees and all issues so triable. He is represented by Douglas J. Giuliano of Giuliano Law PA in Orlando.
