Winter Garden homeowner alleges insurer failed to cover storm damages

ORLANDO — A Winter Garden homeowner is suing an insurer, alleging breach of contract.

Rita Schneider filed a complaint Oct. 12 in Orange County Circuit Court against Southern Fidelity Property & Casualty Inc., alleging failure to pay for damages caused by a storm. 

According to the complaint, while her property at 14436 Hartzog Road, Winter Garden, was actively insured by Southern Fidelity, it sustained damages as a result of wind and hail. However, the suit says, the defendant has refused to tender benefits due to the plaintiff for the covered property loss. 

The plaintiff alleges Southern Fidelity Property & Casualty has failed to make payment for the full amount of Schneider's claim, and obligated her to retain the services of an attorney to bring legal action.

Schneider seeks trial by jury, judgment for all losses with interest on any overdue payments, declaratory relief, attorney fees and court costs. She is represented by attorneys Daniel Gutierrez and Patrick Zurita of Orlando.
