Mother alleges medical care providers' negligence led to newborn's health issues

ORLANDO — An Orange County woman is suing medical care providers, alleging negligence in the delivery of her son.

Jennifer Day, filed a complaint Oct. 11 in Orange County Circuit Court against Adventist Health System/Sunbelt Inc., doing business as Florida Hospital, doing business as Winter Park Memorial Hospital, Dr. John Albrittion et al, alleging they negligently deviated from professional standards of care and treatment.

According to the complaint, on March 9, 2016, Day gave birth to Jonathan Butler, an 8-pound, 3-ounce boy with severe and permanent left brachial injury. The suit says he will continue to sustain unnecessary pain and suffering, disability, loss of capacity to enjoy life and medical expenses. Day says she suffered lost of child support, consortium and society. 

The plaintiff alleges the defendants failed to appropriately interpret a fetal monitor strip and failed to appropriately manage shoulder dystocia.

Day seeks trial by jury, damages of more than $15,000, exclusive of interest, costs and attorney fees. She is represented by attorney Daniel Harwin of Freedland Harwin Valori PL in Fort Lauderdale.
