Woman sues insurer and driver, cites breach of contract and negligence

FORT LAUDERDALE — A Florida woman is suing Progressive American Insurance Company and Nancy Gore, insurer and driver, citing alleged breach of contract and negligence.

Patricia Norton filed a complaint on Oct. 2 in Broward County Circuit Court against the defendants alleging that defendant Gore breached her duty in operating a motor vehicle for the benefit of other individuals.

According to the complaint, the plaintiff alleges that on June 6, 2017, she was involved in an auto collision when defendant Gore, an underinsured driver, failed to exercise reasonable care and caused her vehicle to collide with plaintiff's vehicle. At the time of the occurrence, plaintiff had a policy limits of $250,000 for which she is entitled to recover under a issued by defendant Progressive. The plaintiff holds Progressive American Insurance Company and Nancy Gore responsible because allegedly defendant Gore failed to purchase insurance coverage to fully cover plaintiff's damages and defendant Progressive failed to fully compensate plaintiff's loss.

The plaintiff requests a trial by jury and seeks damages of more than $15,000, costs and all issues so triable. She is represented by Jo Ann Hoffman of Attorneys Jo Ann Hoffman & Associates P.A. in Lauderdale-by-the-Sea.
